These Terms & Conditions govern your use of our website and your purchase of pre-owned two-wheel electric vehicles, including used electric mopeds, electric scooters and lightweight electric motorcycles.

By accessing or using our website, placing an order, or purchasing a vehicle from us, you agree to these Terms & Conditions.

1. Business Scope

SELECT CARS SW LIMITED specialises in the sale of pre-owned two-wheel electric vehicles to individual customers in the United Kingdom.

Our products may include:

  • Pre-owned electric mopeds;
  • Used electric scooters;
  • Lightweight electric motorcycles;
  • Other eligible pre-owned two-wheel electric vehicles listed on our website.

Each vehicle may differ in age, mileage, condition, battery condition, cosmetic condition, equipment and specifications. Product descriptions, photographs and vehicle information should therefore be reviewed carefully before purchase.

2. One-Time Purchase — No Subscription

All vehicle sales made through selectcarssw.shop are one-time purchases of physical goods.

Purchasing a vehicle does not create a subscription, membership, recurring payment arrangement, automatic renewal, rental agreement or ongoing payment obligation.

Unless expressly stated otherwise for a specific transaction, customers pay the purchase price for the vehicle and any applicable delivery charges as a single transaction.

We do not automatically charge customers on a recurring basis after a vehicle purchase.

Any optional third-party services, insurance, finance arrangements, maintenance plans or other services obtained separately are subject to the terms of the relevant third-party provider and are not included as a subscription to SELECT CARS SW LIMITED.

3. Product Information and Used Vehicle Condition

Because our vehicles are pre-owned, normal signs of previous use may be present.

Before purchasing, customers should review the available information concerning:

  • Vehicle make and model;
  • Year or registration information where applicable;
  • Mileage;
  • Battery condition where information is available;
  • General mechanical condition;
  • Cosmetic condition;
  • Previous use where disclosed;
  • Included accessories;
  • Specifications;
  • Known defects, marks or faults;
  • Photographs and other product information.

Descriptions of used vehicles are intended to accurately communicate the condition and characteristics known to us at the time of listing.

Photographs may show minor differences in colour or appearance depending on lighting, screen settings and photography conditions.

Where a particular feature, accessory or specification is not expressly included in the product listing, customers should not assume that it is included.

4. Vehicle Inspection and Pre-Purchase Questions

Customers are responsible for reviewing the vehicle listing and available information before completing a purchase.

If you require clarification regarding mileage, battery condition, accessories, specifications, cosmetic condition or any other material characteristic, you should contact us before placing an order.

We may request additional information or documentation where reasonably necessary to process a vehicle sale.

5. Prices

All product prices displayed on the website are stated in British Pounds Sterling (£), unless otherwise indicated.

The applicable vehicle price is the price displayed at the time the order is placed, subject to obvious pricing errors.

Delivery charges, where applicable, will be displayed before the order is completed.

We reserve the right to correct obvious pricing, description or listing errors. If an obvious error materially affects an order that has already been placed, we will contact the customer and provide an appropriate option in accordance with applicable law.

6. Payment Terms

Payment must be completed using one of the payment methods made available at checkout or otherwise agreed with SELECT CARS SW LIMITED.

An order is not considered fully accepted until payment has been successfully authorised and we have confirmed the order.

We may carry out reasonable payment, fraud-prevention and identity checks before completing a transaction.

If a payment is declined, reversed, cancelled or otherwise not successfully completed, we may suspend or cancel the order.

We do not require customers to make recurring payments for the purchase of a vehicle.

7. Order Acceptance

Submitting an order constitutes an offer to purchase the selected vehicle.

After receiving an order, we may send an order acknowledgement or confirmation. This acknowledgement does not necessarily mean that the vehicle has been dispatched.

A sales contract is formed when we confirm acceptance of the order, subject to these Terms & Conditions and applicable consumer law.

We may decline an order where:

  • Payment cannot be successfully verified;
  • The vehicle is no longer available;
  • There is an obvious listing or pricing error;
  • Fraud or suspicious activity is reasonably suspected;
  • The requested delivery arrangement cannot reasonably be completed;
  • We are unable to comply with applicable legal or regulatory requirements.

Where an order is cancelled by us after payment has been received, we will arrange the appropriate refund.

8. UK-Only Delivery

We currently provide delivery services within the United Kingdom only.

We do not offer international delivery through this website.

Delivery availability may depend on the destination postcode, vehicle size, vehicle condition, battery configuration, transport restrictions and carrier requirements.

Certain remote, restricted-access or otherwise difficult-to-service locations may require additional arrangements or charges. Where this applies, we will inform the customer before dispatch where reasonably possible.

9. Delivery Timeframes and Carrier

Orders are normally prepared for dispatch within 3–5 business days after payment has been successfully confirmed.

For vehicle deliveries, the estimated UK transit period is generally 2–5 business days after dispatch, depending on destination, carrier capacity and vehicle requirements.

The normal overall delivery timeframe is therefore approximately 5–10 business days from confirmed payment, subject to exceptions stated in these Terms.

For larger or palletised vehicles, we may use DHL UK freight, pallet or specialist vehicle logistics services, or another appropriate UK carrier selected according to the size, weight, battery configuration and transport requirements of the vehicle.

Lithium batteries are regulated goods and may require specific handling, packaging, labelling and transport procedures. Carrier acceptance and transport arrangements may therefore vary depending on the vehicle and battery configuration. DHL’s UK guidance confirms that lithium batteries are treated as dangerous/restricted goods and may require specific approval and handling.

Where a specialised transport arrangement is required, the delivery estimate may be longer than the standard timeframe.

We will provide tracking or delivery information where the selected carrier provides tracking.

10. Delivery Appointment and Customer Responsibility

For larger vehicles or palletised deliveries, the carrier may contact the customer to arrange a suitable delivery date or delivery window.

Customers must provide an accurate delivery address and contact telephone number.

Customers should ensure that:

  • The delivery location is accessible;
  • Someone is available to receive the vehicle where required;
  • The delivery area is reasonably suitable for unloading;
  • Any access restrictions are communicated to us before dispatch.

Additional delivery charges caused by incorrect address information, failed delivery attempts, restricted access or customer-requested re-delivery may be payable where permitted by law and where the customer has been informed of the applicable charge.

11. Delivery Inspection

Customers should inspect the vehicle and packaging as soon as reasonably practicable after delivery.

If visible transport damage is present, customers should:

  1. Record the condition of the vehicle and packaging;
  2. Take photographs where possible;
  3. Notify us promptly;
  4. Retain relevant delivery documentation.

Failure to report visible damage immediately does not automatically remove any statutory rights the customer may have.

12. Delivery Delays

Delivery dates are estimates unless a specific delivery date has been expressly agreed as part of the contract.

Delays may occur because of:

  • Carrier disruption;
  • Severe weather;
  • Road closures;
  • Vehicle transport restrictions;
  • Battery transport requirements;
  • Mechanical or safety checks;
  • High-volume periods;
  • Incorrect or incomplete delivery information;
  • Events outside our reasonable control.

Where a delay becomes material, we will communicate with the customer and work toward an appropriate solution.

Nothing in these Terms limits rights that cannot lawfully be excluded under applicable consumer law. UK consumer rules generally require delivery without undue delay and, where no other period has been agreed, within 30 days.

13. Ownership and Risk

Ownership of the vehicle transfers to the customer once the full purchase price and any applicable delivery charges have been paid and the vehicle has been delivered, subject to applicable law.

Risk in the vehicle generally passes to the customer upon delivery.

However, statutory consumer protections relating to delivery, defective goods, misdescription or other matters continue to apply where applicable.

14. Returns and Cancellation

For qualifying online consumer purchases, customers may have a statutory right to cancel within the applicable cancellation period.

For distance sales of goods, UK guidance generally provides consumers with 14 days after receiving the goods to notify the trader that they wish to cancel, followed by a further 14 days to return the goods. Refunds are generally due within 14 days after the goods are returned or appropriate evidence of return is provided, subject to applicable rules concerning deductions for diminished value.

The statutory cancellation regime does not replace or restrict a customer’s separate rights concerning faulty, misdescribed or otherwise non-conforming goods.

Because vehicles are substantial goods and may require specialist transportation, customers should contact us before arranging a return so that we can provide the appropriate return instructions.

15. Used Vehicle Returns

A returned vehicle must be returned in a condition consistent with the customer’s statutory rights and the applicable cancellation rules.

Customers should not:

  • Modify the vehicle;
  • Install aftermarket components;
  • Remove identification marks;
  • Alter the battery system;
  • Carry out mechanical modifications;
  • Damage the vehicle;
  • Use the vehicle beyond what is reasonably necessary to inspect it.

Where a customer has handled or used the vehicle beyond what is reasonably necessary to establish its nature, characteristics and functioning, the customer may be responsible for any legally recoverable reduction in value.

Nothing in this section removes any statutory right relating to faulty or misdescribed goods.

16. Faulty, Defective or Misdescribed Vehicles

Customers retain their statutory rights where a vehicle does not conform to the contract.

Under UK consumer law, goods supplied to consumers must generally be as described, of satisfactory quality and fit for purpose. The legal assessment of satisfactory quality takes account of factors including the description, price and other relevant circumstances, which is particularly relevant to pre-owned goods.

For used vehicles, the assessment may take into account the vehicle’s age, mileage, price, disclosed condition and other circumstances.

If you believe a vehicle is defective or materially different from its description, contact us promptly with:

  • Order details;
  • Vehicle identification information;
  • A description of the issue;
  • Photographs or videos where relevant;
  • Any relevant inspection or diagnostic information.

We will assess the issue and provide the remedy required under applicable law.

17. Refund Processing

Where a refund is approved or legally required, refunds will normally be issued to the original payment method.

We aim to process approved refunds within 3–5 business days after the return has been received and inspected, where applicable.

Where statutory law requires a different refund timeframe, the statutory timeframe will apply.

The time for funds to appear in the customer’s account may additionally depend on the payment provider or customer’s bank.

18. Intellectual Property

All intellectual property rights relating to this website and its original content are owned by or licensed to SELECT CARS SW LIMITED unless otherwise stated.

This includes, where applicable:

  • Website design;
  • Text;
  • Product descriptions created by us;
  • Photographs owned or licensed by us;
  • Graphics;
  • Logos;
  • Page layouts;
  • Branding;
  • Website structure;
  • Original marketing materials.

Customers may access and use the website for personal and lawful shopping purposes.

Without our prior written permission, customers must not:

  • Copy substantial portions of website content;
  • Reproduce our original photographs for commercial purposes;
  • Republish our product descriptions;
  • Scrape or systematically collect website content;
  • Sell, license or redistribute our website content;
  • Reproduce our branding or logos;
  • Use our content to create a competing website or commercial catalogue.

Third-party trademarks, vehicle manufacturer names and other third-party intellectual property remain the property of their respective owners.

19. Acceptable Use

Customers may use this website only for lawful purposes.

You must not use the website to:

  • Commit or facilitate fraud;
  • Provide false identity or payment information;
  • Attempt unauthorised access;
  • Interfere with website security;
  • Introduce malicious code;
  • Scrape website information in a manner that places unreasonable load on our systems;
  • Attempt to bypass security measures;
  • Use automated systems to place fraudulent orders;
  • Misuse customer accounts;
  • Harass our staff;
  • Submit unlawful, threatening or abusive content;
  • Use our website for any illegal activity.

We may suspend or restrict access where we reasonably believe that a user has violated these rules.

Where appropriate, we may cancel fraudulent or abusive orders, refuse future transactions, report suspected unlawful activity to relevant authorities, or take other lawful action.

20. Customer Accounts

If account registration is available, customers are responsible for maintaining accurate account information and protecting their login credentials.

Customers must not share an account for fraudulent or unlawful purposes.

We may suspend an account where we reasonably believe that it has been compromised or misused.

21. Website Availability

We aim to keep the website available and accurate but do not guarantee that the website will always operate without interruption.

Temporary interruptions may occur because of:

  • Maintenance;
  • Hosting issues;
  • Security incidents;
  • Technical failures;
  • Network problems;
  • Events outside our reasonable control.

We may update, modify or discontinue website features where reasonably necessary.

22. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

This includes liability for matters such as death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability that applicable consumer law does not permit us to exclude.

Subject to those limitations, we are not responsible for:

  • Indirect or consequential losses where such exclusion is legally permitted;
  • Losses arising from unauthorised use of a customer’s account;
  • Losses caused by inaccurate information supplied by the customer;
  • Delays caused by circumstances outside our reasonable control;
  • Losses resulting from unlawful or improper use of the vehicle by the customer;
  • Business losses where the customer is purchasing wholly or mainly for business purposes and applicable law permits such limitation.

Nothing in this section affects statutory consumer rights.

23. Vehicle Use and Legal Compliance

The customer is responsible for using the vehicle in accordance with applicable UK laws and regulations.

The customer is responsible for determining whether the purchased vehicle may lawfully be used on a particular road, cycle path, private property or other location.

Depending on the vehicle type and specifications, legal requirements may include matters such as:

  • Registration;
  • Insurance;
  • Driver licensing;
  • Vehicle classification;
  • Roadworthiness;
  • Helmet requirements;
  • Lighting and equipment requirements;
  • Road-use restrictions.

Customers should confirm the applicable requirements for their specific vehicle and intended use before operating it on public roads.

The sale of a vehicle does not constitute legal advice or a representation that a particular vehicle is automatically authorised for every form of road use.

24. Third-Party Websites and Services

Our website may contain links to third-party websites or services.

We are not responsible for the content, security, availability or privacy practices of third-party websites.

Any third-party service is governed by that provider’s own terms and policies.

25. Events Beyond Our Reasonable Control

We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including:

  • Natural disasters;
  • Severe weather;
  • Fire;
  • Flood;
  • Epidemics;
  • Transport disruption;
  • Road closures;
  • Industrial disputes;
  • Power or telecommunications failures;
  • Cybersecurity incidents;
  • Government action;
  • Changes in applicable law;
  • Carrier restrictions;
  • Battery transportation restrictions.

Where reasonably possible, we will notify affected customers and take reasonable steps to minimise the impact.

26. Complaints

If you have a complaint, please contact:

Email: shop@selectcarssw.shop
Phone: +44 7891 850640
Address: East Compound, Milestone Business Park London Road, Whimple, Exeter, England, EX5 2QB

Please provide your order number and a clear description of the issue.

We aim to acknowledge complaints within 3 business days and provide a substantive response within 10 business days, where reasonably possible. More complex matters may require additional time, in which case we will keep the customer informed.

27. Dispute Resolution

Customers should first contact us directly so that we have an opportunity to investigate and resolve the issue.

Where a dispute cannot be resolved through direct communication, the parties may consider appropriate alternative dispute resolution (ADR), mediation or other dispute-resolution mechanisms available under applicable UK law.

Nothing in these Terms prevents a consumer from exercising any statutory right to bring a claim before a competent court or use another legally available dispute-resolution route.

28. Governing Law

These Terms & Conditions are governed by the laws of England and Wales, subject to any mandatory consumer protection laws that apply to the customer.

The courts of England and Wales will have jurisdiction over disputes, subject to any mandatory jurisdictional rights available to consumers under applicable law.

29. Changes to These Terms

We may update these Terms & Conditions from time to time.

The version applicable to an order will generally be the version in force when the relevant contract is formed, unless a change is required by law or otherwise agreed with the customer.

The latest version will be published on this website.

30. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

31. Entire Agreement

These Terms, together with the applicable product listing, order confirmation and other policies expressly incorporated into the purchase, form the agreement governing the relevant transaction.

Nothing in these Terms excludes or restricts statutory consumer rights.
